You agree to adhere to all applicable laws, regulations, and codes of conduct when using the EPC ACCESS website.

You agree not to:

Damage, interfere, or disrupt the website or access to the website;

Gain or attempt to gain unauthorised access by any means to any restricted EPC ACCESS computer networks or systems;

Make available, upload, or distribute on the EPC ACCESS website any materials or files that contain viruses or any other harmful software;

Use the website to send unsolicited material for any purpose.
Althoug EPC ACCESS endeavours to ensure the contents of this website is correct it shall not be liable for any damages arising in contract, tort, or otherwise from the use of or inability to use this site, or any material contained within it, or from any action or decision taken as a result of using this site or any such material.

A link does not imply an endorsement of a site; likewise, not linking to a particular site does not imply lack of endorsement.

Payment Terms and Conditions
1. Payment
​
1.1 Services must be paid on site during the assessment, whether using our card reader payment or in cash.
​
2. Your Obligations
​
2.1 You agree to ensure that the information that you supply to us in the Order including without limitation details of the Property is complete, accurate and up to date. You will notify us immediately you become aware of any inaccuracy contained within the Order.
​
2.2 You agree that any order that we may deliver to you is delivered on the understanding that it is only for your use and for the purpose that you have disclosed to us.
​
2.3 In the case of an Energy Performance Certificate. You agree to have any insulation certificates, at the time of inspection, available to the assessor. Any instance where the certificates are not available may result in insulation being recorded as ’not present’ or ‘unknown’.

2.4 You agree that if you note an error within the certificate either with the rating, recommendation or address you will highlight this within
1 month of instruction of the service. After this date we are unable to make amendments.
​
2.5 You agree that the service rendered commences immediately upon purchase. This includes the necessary administration and is not restricted to the site visit or production of documentation.
​
2.6 You agree that the service and turnaround time described is not a guarantee and accept that adherence to this may not be possible in all instances. You agree to notify us as soon as is reasonably practicable if you have not received the described service. You will not be entitled to a refund of the full service fee if the turnaround time not being as described.

3. Liability
​
3.1 We cannot accept any liability for any error in a report which is based on any error or inaccuracy in a public register. Nor will we be liable for any information contained within a report which is based on information that we have obtained from a third party (not being information derived from the public register).
​
3.2 We cannot accept any responsibility for any inaccuracy or error in the report that is based on incomplete or inaccurate information supplied by you.
​
3.3 Subject to any other provisions in these Conditions, we will not be liable to you for any loss,damages, costs or expenses caused directly or indirectly by a delay in delivery to you (even if caused by our negligence).
​
3.4 We will not be liable for any loss of actual or anticipated profits or savings, loss of business, loss of opportunity or for any special, indirect or consequential loss whether arising from a breach of these Conditions or negligence in performing the Services even if we were advised of or knew of likelihood of such loss occurring.
​
3.5 Our entire aggregate liability to you for direct loss arising from our being in breach of these Conditions or negligent in the course of performing the Services will not exceed the cost of the Service.
​
3.6 If ordering an EPC, by placing an order you are confirming that you require us to complete an EPC and replace any in date and active EPCs that may exist, even if no changes have been made to the property.

4. Pricing
​
4.1 The Website prices quoted are for properties anywhere in the area described in our website .
​
4.2 Payment is due from you on submission of your order for the service of our fieldworkers and if we do not receive payment from you on order, we reserve the right to cancel your order and terminate our services forthwith.
​
4.3 If you require a copy of your report sent by post then a £5 charge will apply.
​
4.4 The method of payment will be as agreed between us.
​
4.6 Following receipt of payment, the allocated fieldworker will confirm acceptance of the booking to the Client via telephone to the contact number provided.
​
4.7 If your Instruction is made under false pretence an additional fee may be due and the report will not be issued until we receive receipt of said additional fee.
​
4.8 You are aware that the services are to be provided to you by a third party.
​
5. Acting as an agent
​
5.1 EPC ACCESS act as an agent in placing the instruction for the completion of an EPC or other product, for facilitating this process we charge a booking fee. EPC ACCESS are responsible to taking and holding the payment for any service instructed and will disperse the funds accordingly only after receiving notification that the instruction has been successfully completed by the assigned fieldworker. By agreeing to these terms you accept that any contract formed by making a payment will be between yourself and the assigned fieldworker.

6. Floorplans
​
6.1 The plans are provided are basic floorplans of limited detail for illustrative purposes only. They will not be to scale or land registry compliant.
​
6.2 The floorplans will be as accurate as the software will allow. The basic floorplan is not required to include exact measurements. These can be added at your request however it is your responsibility to provide us with the accurate information.
​
6.3 Floorplans will provide the size and layout of the building and any permanent structures true to the time of the assessment.
​
6.4 If a floorplan needs to be amended then a copy of the plans showing the amendments will need to be emailed into the office the alterations will then be made accordingly.
​
6.5 It may not be possible to obtain a full refund for a completed floorplan (see section 5. Cancellation).
​
7. Coverage
​
7.1 Whilst we endeavour to provide local coverage there may be some exceptions, which will be dealt with on a case by case basis. If we are not able to cover your required area at the time of booking, a member of staff will contact you as quickly as possible to discuss alternative options. In some circumstances, we may be able to complete the instruction after agreeing a rural surcharge fee with the client but this will be dealt with on an ad-hoc basis.

8. Data and Personal Information
​
8.1 On placing an order, you agree to the following information being provided to a third party contractor assigned by us: Name, Phone number, Address, Email address, Tenants/Agents phone number (If applicable), Key Safe code (If applicable)
​
8.2 If you are placing an order on behalf of someone else, you confirm that you have permission to do so.
​
8.3 On completion of an order you agree that your information will be kept on file for the foreseeable future.
